Kharbatha Bani Harith: marking the army base and access road to it, that will divide the village into its northern and southern parts

We visited the local council of Kharbatha Bani Harith village and met the village council chairman, Omar Alian – an engineer by profession who studied in Algeria and worked for UNWRA.
The village number 3,800 inhabitants who own about 7,000 dunams of land. About 15% of the village area lies in Area B (supposedly under Palestinian civil control and Israeli military control), and the rest in Area C (under total Israeli control).

Landgrab – like many other villages in the West Bank, Kharbatha Bani Harith too has been damaged by the separation fence erected by Israel. In 2004 they petitioned the construction of the fence, contacts were held with the Israeli army in order to agree on a route acceptable to both sides. The first route offered by Israel separated the villagers from their farmlands. It was moved a bit but still did not solve the problem and they could not accept it. The Supreme Court accepted the state’s claim that “’security needs necessitate completing the fence as soon as possible”, and that damage to the petitioners did not seem serious. Palestinians are robbed of their land and the judges of the Supreme Court do not see this as serious damage and bless the land grab.

In 2007 a boulder barrier was placed on the road exiting Kharbatha Bani Harith towards Ras Karkar (the Post Junction, road 463). This barrier prevents the surrounding villagers from traveling east to Ramallah and ever since they must use bypass roads that demand a longer ride.

The Jewish settler-colonies in the area are Kiryat Sefer-Modi’in Ilit, Nili, and Na’ale.

The army plans to construct an army base on the lands belonging to the villagers. The landowners are bringing legal suit against the army. Our host was not sure whether they are assisted by a lawyer. The road to the army base will divide the village into north and south parts.

The entire region is hilly and rocky. Olive trees are planted in every bit of accessible land. All in all they own about 1000 dunams of olive groves.

Livelihood: some of the villagers are employed by the Palestinian Authority, some in the Jewish settler-colonies, and a small number work in Israel-proper, entering it through the Na’alin checkpoint.

In addition to the “official” landgrab, hills-youth have settled on the hilltop above the village in order to take over the farmers’ lands and steal the olive trees. Their living structure is equipped with solar panels for electricity and a water tanker. From their high vantage point the boys observe the villagers, and as soon as anyone enters his area to tend to the olive trees, they descend, armed, and chase him away with stone-throwing. Soldiers serving in the area are naturally welcome guests. As in many other cases, the present structure will soon be joined by others and in the near future this will turn into a new settler-colony. At first it will be considered illegal, and eventually turn into a permanent community.

We drove with our Hebrew-speaking host in his vehicle around the village, he told us that in talks he had with soldiers he heard from them that his claims are justified but that the soldiers’ job is to protect the youths, these are their instructions. And instructions, as we well know, must be followed.

Water – there’s a problem. The village receives an insufficient allotment of water from the Israeli Mekorot water company. The village has placed a request to increase it about two months ago. Inside the village only a few water holes exist. Water pressure is low and the water does not reach houses situated in higher spots.

Electricity – no problems.

There is a recreation park nearby, built by Bir Zeit University. The bosses on the hilltop (Jewish hills youth and settler-colonists), armed with pistols, do not allow Palestinians to approach it, and thus the beautiful, well-planned site remains closed and inactive.

Ras Karkar – We arrived at 1 p.m. and the council house was already closed. We entered the grocery and heard from the storekeeper that they have many problems with the Jewish settler-colonists. We promised to return some other day.

On our way back we stopped at the nursery near the Habla checkpoint. Soon the soldiers there will be replaced. Here people hope that the soldiers will treat them fairly. At least that. The Occupation authorities enables passage at Habla checkpoint only of vehicles carrying plants. Flower pots, blocks and other agricultural products must go through Eliyahu checkpoint to undergo careful inspection.

חרבתא בני ח'ארת: כך נראה הכפר מרחוק

 

בקרנו במועצה של הכפר חרבתא בני חארת'  - Kharbatha Bani Harith

 

פגשנו את ראש המועצה עומר עליאן, מהנדס במקצועו שלמד באלג'יריה ועבד באונר"א.

 

בכפר 3,800 תושבים להם כ-7,000 דונם. כ-15% משטח הכפר נמצא באזור B  והשאר באזור C.

 

גזל אדמות – כמו כפרים רבים  בגדה גם חרבתא בני חארת' נפגעו מבניית הגדר. בשנת 2004 הגישו עתירות נגד בנייתה, התקיימו מגעים בינם לבין הצבא בניסיון להגיע לתוואי שיהיה מוסכם על שני הצדדים. התוואי הראשון שהוצע ע"י ישראל חצץ בין התושבים לאדמותיהם. התוואי הוזז מעט אבל עדיין לא פתר את בעייתם והם  לא יכלו להסכים לו. בג"צ קבל את טענת המדינה שטענה כי "קיים צורך בטחוני להשלמת הגדר בהקדם". וכי הפגיעה בעותרים לא נראית להם חריפה.  גוזלים אדמות מפלסטינים ושופטי בג"צ לא רואים בזה פגיעה חריפה ומקדשים את הגזל.

 

בשנת 2007 הוצב חסם סלעים על הכביש היוצא  מחרבתא בני חארת' לכיוון ראס כרכר (צומת הדואר, כביש 463). החסם מונע מתושבי הכפרים בסביבה לנוע מזרחה לרמאללה ומאז הם נאלצים לנסוע בדרכים עוקפות המאריכות את הנסיעה.

 

ההתנחלויות באזור קריית ספר – מודיעין עילית, ניל"י, נעלה.

 

הצבא מתכנן להקים בסיס צבאי על אדמות של אנשי הכפר. בעלי האדמות תובעים את הצבא. לא היה ברור למארח שלנו אם הם נעזרים בעו"ד. הדרך אל הבסיס הצבאי תחלק את הכפר לשניים, צפון ודרום.

 

כל האזור הררי וסלעי. עצי זית  נטועים בכל פיסת קרקע שאפשר להגיע אליה. סך הכול יש להם כ-1000

דונם עצי זית.

 

פרנסה – חלק מהתושבים עובדים ברשות הפלסטינית, חלק בהתנחלויות וחלק קטן עובדים בישראל ונכנסים אליה דרך מחסום נעלין.

 

בנוסף לגזל האדמות "הרשמי" התיישבו להם נערי הגבעות על ראש גבעה מעל לכפר במטרה להשתלט על אדמות הכפריים ולגזול את עצי הזית.  המבנה שלהם מצויד בפנלים סולריים ליצור חשמל ועוקב מים. ממרום מושבם הנערים צופים באנשי הכפר, וכשמישהו נכנס לשטחו לעבד את הכרם הם יורדים חמושים ומסלקים אותו מאדמתו ביידוי אבנים.  חיילים המשרתים באזור מתארחים אצלם כמובן. כמו במקרים רבים אחרים אל המבנה הקיים יתווספו בקרוב עוד מבנים ובעתיד הקרוב זו תהיה התנחלות חדשה, בהתחלה בלתי חוקית, ובהמשך יישוב קבע.

 

נסענו עם המארח שלנו (דובר עברית) ברכבו סביב הכפר, הוא סיפר שבשיחות שניהל עם החיילים שמע מהם שהוא צודק בטענות נגדם אבל תפקידם לשמור עליהם כי אלה ההוראות. הוראות כידוע צריך למלא.

מים – יש בעיה. הם מקבלים ממקורות כמות שאינה מספיקה. הגישו בקשה להגדלת המכסה לפני כחודשיים. בתוך הכפר ישנן רק מעט בארות. לחץ המים נמוך והמים לא מגיעים לבתים במקומות הגבוהים.

חשמל – אין בעיות.

במקום יש כפר נופש שנבנה על ידי אוניברסיטת ביר זית. בעלי הבית שבראש הגבעה, חמושים באקדחים, אינם נותנים לפלסטינים להתקרב וכך נשאר המקום המטופח  והיפה הזה סגור ולא פעיל.

 

ראס כרכר

הגענו בשעה 13:00 והמועצה כבר היתה סגורה. נכנסנו למכולת ושמענו מבעליה שיש להם המון בעיות עם המתנחלים. הבטחנו לחזור ביום אחר.
בדרך חזרה עצרנו במשתלה ליד מחסום חבלה. בקרוב מתחלפת הפלוגה שתפתח את שער המחסום. פה מקווים שיזכו מהחיילים ליחס הוגן. לפחות זה. שלטון הכיבוש מאפשר מעבר  במחסום חבלה של רכבים עם שתילים בלבד. אדניות, בלוקים ומוצרים אחרים לחקלאות חייבים לעבור דרך מחסום אליהו כדי לעבור בדיקה קפדנית.
