Russian Compound, Jerusalem - Barred (from meeting with attorney), Detention until conclusion of proceedings
Translation: Marganit W.
Judge: Lieut. Col. Menahem Lieberman
Police Investigator: Nasib Safa
Defense: Firas Sabah, Ma’amoun Hashim, Judd Kadmani
There are 6 cases in the docket, one of them of a minor, and two are barred from seeing counsel.
One of the ‘barred’ detainees – Muhammad Mazhar Muhammad Nazel – ID 402612584 – has been transferred to Ofer. His attorney received the information at the last minutes, just before she entered the court.
Abd Algani Nader Abd Algani Mubarak – ID 850302225
Arrested on 29.5.17.
He is represented by Atty. Sabah.
The police requested 8 additional days.
The defense goes straight to summation and objects to the police’s request. This is the second extension. There has been no progress in the investigation. The police failed to present evidence to convict him. He demands immediate release.
Justice Lieberman’s summation: He was arrested two weeks ago on charges of dangerous military activity. As the defense mentioned (and as written in the secret file) there is no progress in the investigation since the arrest. “I find no grounds to continue the detention. Since there is no progress, I order him released against a 3000-shekel bail to ensure he shows up in court if the investigation requires it”.
The Investigator immediately ran to the other investigators asking them to explain to the judge how dangerous the detainee is.
The judge told the Investigator that Police Investigators have no status in the hearing.
Ahmad Hasan Sabati Abu Hasin – ID 854508702
Muhammad Hassan Sabati Abu Hasin – ID 860060326
The two are brothers and were brought in from prison where they are held until the conclusion of the proceedings. There are new suspicions in their case. There is an agreement on an 8-day extension and transfer of the cases to the prosecution.
Muhanned Abd el-Bast Ribhi Shubaka – ID 859347783
He is barred from seeing counsel, so we can only stay during the part when his attorney pleads.
This is his first remand extension.
The Police investigator requests 15-day extension.
Defense Summation: This is the first remand extension. The detainee does not seem to admit the charges against him. Even though not much time has passed since the arrest, the police has to show that there is progress in the investigation.
Thus, the defense requests a reduction in the number of days, to strike a balance between a fair trial and the detainee’s rights.
